This Privacy Policy

The Grimsey Group (excluding Hall Consulting Group) has adopted this policy (Privacy Policy) concerning the collection, use, disclosure and handling of personal information. Hall Consulting Group has its own separate privacy policy.

Grimsey Group

The Grimsey Group is comprised of the following entities:

  • Grimsey Wealth Pty Ltd;
  • Grimsey Pty Ltd;
  • Grimsey (NSW) Pty Ltd;
  • Grimsey Wealth (NSW) Pty Ltd;
  • Hall Consulting Group Pty Ltd.

In this Privacy Policy, references to “Grimsey Group”, “we”, “us” and “our” are references to the entities listed above (except for Hall Consulting Group) and any corporate entity owned or controlled by these companies.

Our commitment

Grimsey Group is committed to protecting the privacy of individuals and is bound by the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (Privacy Act). We will only collect, use or disclose personal information in accordance with the Privacy Act and this Privacy Policy.

The kinds of personal information we collect

The personal information that we collect depends on the nature of your interactions with us. We collect both personal information and non-personal information. In this Privacy Policy, personal information has the meaning given to it in the Privacy Act, and includes information or an opinion, whether true or not, about an identified individual or an individual who is reasonably identifiable.

The kinds of personal information which we collect includes the following:

  • Name, contact details and identification information such as your tax file number;
  • Family details including spouse and dependants;
  • Employment information – current and history;
  • Financial information – bank accounts, shareholdings, loans;
  • Financial circumstances – assets and liabilities, credit reporting, income, expenditure, insurance, superannuation;
  • Financial needs and goals;Risk and investment preferences; and
  • Insurance arrangements or sensitive information that might be required to obtain insurance cover

How we collect and hold personal information

We will generally collect personal information:

  • From you directly when you provide your details to us;
  • From you indirectly such as through emails, forms, face-to-face meetings, business cards, online queries, telephone conversations, and social media channels (including our blogs and LinkedIn channels); and
  • In some circumstances, from a third party, once authorisation has been provided by you. You have the right to refuse us authorisation to collect such information from a third party.

Why we collect, hold, use and disclose personal information

We collect, hold, use and disclose personal information from you for the primary purpose for which it was collected, which would generally be to provide you with accounting, tax, wealth advisory, lending and related services. Other purposes for which your personal information may be collected, held, used or disclosed include:

  • To market our products or services to you;
  • To help us manage, develop and enhance our services, including our website;
  • To consider the suitability of prospective employees; and
  • To administer, maintain, support, and provide upgrades to our services.

We may also use and/or disclose your personal information for other purposes which you consent to, or which are required or permitted by law. This may include for a secondary purpose that is related to a primary purpose for which we collected it, and for which you would reasonably expect us to use or disclose your personal information.

The fact that we have collected personal information from you does not necessarily mean our financial advisers or financial planners have considered your personal circumstances when providing you with financial advice.  If you are unsure whether you have been given general advice or personal advice from our financial advisers or planners, please consult them directly.

How do we protect your personal information

We take reasonable steps to ensure the security of any personal information that we hold, to protect it from misuse, interference and loss, arising from unauthorised access, alteration or disclosure. Such steps include:

  • Secure storage of your information;
  • Access passwords;
  • Firewalls on all devices;Multi-factor authentication
  • Staff training and education to prevent unintended disclosures

However, we cannot guarantee that your personal information will be free from misuse, interference and loss, unauthorised access, alteration or disclosure. To the extent permitted by law, we exclude all liability (including in negligence) for the consequences of any misuse, interference, loss,  unauthorised access, alteration or disclosure of your personal information.

Who we may disclose your personal information to

We may disclose your personal information for the purposes for which it was collected (as described above) to:

  • Another Grimsey Group entity, representative, employee, agent, relationship manager, contractor or external service provider;
  • The Australian Taxation Office (ATO) to meet ongoing compliance;
  • The Australian Securities & Investments Commission (ASIC) or Financial Advice Association of Australia (FAAA) on request to meet ongoing compliance, mandatory professional standards or other legal obligations;
  • Insurance providers, superannuation fund managers and product issuers for the purpose of implementing your financial plan in accordance with the recommendations made by us;
  • Administrative service providers in regard to your investments to assist them with reporting, providing distributions and any other administrative tasks relating to your investments;
  • Our panel of approved SMSF auditors to arrange for the audit of your SMSF;
  • Approved entities who recommend and implement a direct share arrangement as part of your financial plan;
  • Persons who provide finance or other financial products to you or to whom an application is being or has been made on your behalf;
  • A credit reporting body to obtain a credit report on your behalf;
  • As required by law or directed by legal decision/process;
  • Financial consultants, lawyers, accountants and advisers;
  • Any industry body, tribunal, court or otherwise connected with any complaint regarding our services; and
  • Any financial institution which you hold an account where you have given us permission to make enquiries on your behalf.

When we may disclose your personal information overseas

Grimsey Group is likely to disclose personal information to overseas recipients.

The countries in which these recipients are located will depend on the circumstances.  However, in the course of our ordinary business operations we commonly disclose personal information to third parties located in the following countries:

  • The Philippines
  • India

How you may access and correct your personal information

Subject to the exceptions set out in the Privacy Act, you may seek access to and correction of the personal information which we hold about you by contacting us through the details set out in the section titled ‘Contact Details’. 

We ask that you provide your request in writing specifying what information you require correction and/or access to. We will also require you to verify your identity for security reasons.

We may charge for providing access to this information and we may refuse access where the Privacy Act allows us to do so.

How you may make privacy related complaints

If you wish to complain about a breach of your privacy or the handling of your personal information by us, please contact our Privacy Officer through the details set out in the section below titled ‘Contact Details’. We may ask you to lodge your complaint in writing. Any complaint will be investigated by our Privacy Officer and you will be notified of the making of a decision in relation to your complaint as soon as is practicable after it has been made, usually within 30 days.
